The people of all forty-seven communities, development organizations, local and municipal government of the municipality of San Juan Maya Mam Ostuncalco, Quetzaltenango department, at the national and international media and general population, with the fourth robbery and threats due to mining policies that harm to Mother Nature and its people, communicate the following:
1. That in the territory of our Mam Mayan people of Quetzaltenango and particularly in the municipalities of Huit, San Carlos Cabricán and licenses are authorized Sija mining exploration of gold, silver, zinc and other metals, which are identified with the names of: LR-O74 MAQUIVIL Registry, Registry Calel LEXR-828, Record ELUVIA LEXR-010-06, MARINA Register LEXR-08-06 , all approved by the Ministry of Energy and Mines - MEM - no information or prior consent of our peoples, ancestral owners of this land.
2. Mam Maya as a people will Txeljub '(Quetzaltenango), Chnab'Jul (Huehuetenango), Txe Chman (San Marcos) and Toj Mlaj' (Retalhuleu), members of the Mam of Guatemala Mayor, Council of Peoples of the West - CPO and Grand National Council and Regional Authorities Ancient Maya, Garifuna and Xinca, today more than ever we are organized and united in preserving Mother Earth and in Defense of the Territory that historically belongs to us.
3. Today Wajxaq Q'anil the year 5126, (18 February 2011), like Mam Mayan people of Oxe K'al Tun, together with our Municipal Government, we celebrate our Good Faith Community Consultation, protected by the Constitution of the Republic , Convention 169 of ILO and United Nations Declaration on the Rights of Indigenous Peoples, Municipal Code and Law on Urban Development Councils y Rural; y lo más importante utilizando nuestras formas propias de organización, formas de toma de decisiones tal y como nuestros abuelos y abuelas nos enseñaron.
4. De acuerdo al resultado de la consulta comunitaria de buena fe realizada hoy diez y ocho de febrero de 2011, en la que participaron masivamente niños, niñas, jóvenes, señoritas, adultos, mujeres, ancianos y ancianas: TREINTA Y OCHO MIL SEISCIENTOS TREINTA PERSONAS (38,630) RECHAZAMOS ENERGICAMENTE LA EXPLOTACION MINERA EN NUESTRO TERRITORIO, porque estamos conscientes de sus consecuencias, como ha quedado demostrado en los territorio del pueblo Maya Mam de San Miguel Ixtahuacán and Sipakapense Maya people in San Marcos. 5. Faced with this decision of our Mam Mayan people of San Juan Ostuncalco, demand:
a). Central Government through the Ministry of Energy and Mines and Ministry of Environment and Natural Resources NOT EXTEND LICENSES FOR EXPLORATION AND EXPLOITATION OF MOTHER EARTH and CANCEL ALL LICENSES AND GRANTED IN OUR CITY AND ALL THE MUNICIPALITIES IN THE COUNTRY hydroelectric mega projects matters relating to the Technology Corridor and the Pacific coast, as well as for the cement factory in San Juan Sacatepéquez, and not with the consent and authorization for our peoples.
b). A transnational corporations demand the respect for the decisions of our people, adhering to compliance with national and international laws.
c). We join the struggle of Mam Mayan people of San Miguel community and Sipakapense Mayan people, for the government to give effect to the precautionary measures issued by the Human Rights Commission - Commission and call for the immediate suspension of the operation mining in our territory.
6. INVITE the original peoples of Guatemala, to join the cause of our struggle, to make a common front against the public policies that threaten our rights as peoples.
7. And all the media will report truthfully demand attached to the reality of our peoples.
