James Anaya, Special Rapporteur of the United Nations yesterday submitted its report on the lack of consultation with indigenous peoples in relation to mining and other activities in their ancestral territories.
Anaya gave an interview to Prensa Libre in which deepened over the report and expressed concern about the use of states of emergency, such as the tax in Alta Verapaz, and how these will not help overcome the climate of conflict. In addition, he spoke of the draft rules of community consultation.
How does the situation regarding states of emergency in Guatemala?
In my opinion and information I have received have not helped to promote solutions to fundamental problems, and instead have been perceived as another form of intimidation.
We are concerned that states use exception does not help, rather hinder. While not resolve the substantive issues on land, consultations and projects, promote more problems.

What changes would you make the rules?
I made my suggestions, the Government took into account some and not others. Now you need to know what changes would make indigenous peoples. I insist that the position should be considered them.
Is it enough of a regulation or law is needed?
is a matter of law. My concern is that any process that is safe, fair and abide by the decision of the indigenous communities.
